Real Estate Law · Lawyers in Madrid

Comprehensive real estate advice on domestic and cross-border transactions, always reflecting the firm's approach: legal rigour and tax planning from the outset.

Established experience

We have extensive experience in the sale, purchase and leasing of real estate — urban, rural, residential and commercial — in Spain and abroad. Real estate transactions require attention to detail in the contractual terms, the legal status of the property, and above all in carefully planned taxation that establishes the right structure to maximise the investment and minimise its cost.

Real estate services

  • Review of the legal status of the property (due diligence).
  • Negotiation and drafting of contracts: sale, lease, exchange, option to purchase, reservation agreements and Spanish contrato de arras arrangements.
  • Horizontal property regime.
  • Advice on financing the transaction.
  • Analysis and design of the legal structure to acquire the property, including company formation.
  • Real estate complexes: shopping centres, leisure centres, hotels and offices.
  • Representation before notaries and Spanish homeowners’ associations.
  • Pre-litigation and litigation advice.
  • Real estate taxation and ancillary procedures.

Foreign investment after the repeal of the investor-residency regime

Spain has repealed the investor-residency regime set out in articles 63 to 67 of Law 14/2013, by Organic Law 1/2025, with effect from 3 April 2025. We support foreign investors acquiring real estate in Spain with the legal and tax structuring of the transaction, and with coordination with immigration specialists where alternative residency routes unrelated to the former investor regime are to be analysed.
